Terms of Service Agreement

1. Agreement Overview
By placing an order with Elevated Windows, you (the "Customer") agree to the following Terms of Service. These terms apply to all transactions between the Customer and Elevated Windows for the purchase, installation, and services related to window treatments.

2. Deposit & Payment Terms
A 50% deposit is required before any custom order is placed or services are rendered. The remaining balance is due upon completion of the installation. All prices include a 3% convenience fee. Save 3% when paying by cash, check, Zelle, or Venmo. Payment is also accepted via PayPal or credit/debit card. Full payment must be received within 10 days of the final invoice date. Late payments will incur a 2% late fee per month on the outstanding balance.

3. Cancellations, Refunds, & Final Sales
All sales are final. Orders for custom window treatments are non-refundable once the deposit has been made and materials ordered. If the Customer cancels the order before materials are purchased, a full refund of the deposit will be provided. No refunds are given once installation has been completed. If there is any defect in materials or installation, please see the warranty terms below. Refunds, if applicable, will be processed within 5 business days.

4. Warranty & Repairs
Elevated Windows offers a Limited Lifetime Warranty on all custom window treatments for Oregon and Washington customers only, valid for as long as the original purchaser owns the home where the products were installed. This warranty includes a 5-year motor warranty and a 1-year installation workmanship warranty. Replaced parts under warranty are covered for the remainder of the original warranty period.

For Texas and California customers, Elevated Windows offers a 3-year limited warranty covering defects in materials, motors, and mechanisms under normal residential use.

What’s Covered:
• Manufacturer defects in materials, fabric, hardware, or mechanisms under normal residential use
• Malfunctions or defects in motors, remotes, or shade mechanisms (5 years OR 3 years depending on location)
• Installation workmanship that causes improper function (1 year – Oregon/Washington only)
• Hardware failure not caused by misuse or environmental factors

What’s Not Covered:
• Damage due to misuse, abuse, improper operation (e.g., pulling on motorized shades)
• Normal wear and tear, fading, discoloration, or warping from sun exposure or moisture
• Environmental damage (water, mold, fire, pests, etc.)
• Attempted repairs or modifications by anyone not authorized by Elevated Windows
• Products installed in commercial or high-use environments, unless otherwise stated in writing

One-Time Reorder Discount:
If you are not fully satisfied with your custom order, Elevated Windows offers a one-time 40% discount on a replacement order of the same product type, valid within 30 days of the original installation date. This offer allows for adjustments in color, size, or style, and may include new measurements if needed.

Claim Process:
To file a warranty claim, notify Elevated Windows within the applicable warranty period. Claims must include a written description of the issue and photos. If the issue qualifies under warranty, Elevated Windows will repair or replace the item at no cost for parts or labor. Travel charges may apply for service calls beyond a 30-mile radius of Portland, Oregon.

Additional Notes:
• Warranty applies only to the original purchaser and the original installation address.
• Warranty is void if products were installed in unsuitable or unsafe conditions, as determined at installation.
• Costs associated with removal, reinstallation, or shipping may apply unless otherwise specified.
• Warranty term depends on installation location:
 – Oregon & Washington: Limited Lifetime Warranty
 – Texas & California: 3-Year Limited Warranty

This warranty policy applies to orders placed on or after June 1, 2025.

5. Installation Services
Elevated Windows will perform all installation services with care and professionalism. The Customer is responsible for ensuring that the installation area is prepared and accessible on the agreed-upon date. This includes removing existing window treatments and moving furniture away from windows. Elevated Windows will not move or reinstall any existing window treatments unless agreed in writing. If the Customer needs to reschedule installation, at least 48 hours' notice is required. Elevated Windows is not responsible for delays caused by circumstances beyond its control, such as weather, construction, or shipping delays.

6. Ownership & Liability
Once installation is complete and payment is received, ownership of the window treatments transfers to the Customer. Elevated Windows is not responsible for any damage to the products or property after installation, except as covered by the warranty.

7. Care Instructions
Proper care of window treatments is essential to maintain the appearance and functionality of the products. Please follow the care instructions provided with your shades (available on the invoice) to ensure long-lasting performance. Failure to properly care for the window treatments may void the warranty.

8. Limitation of Liability
Elevated Windows will not be liable for any indirect, special, or consequential damages resulting from the use or installation of its products. In no event will the liability exceed the amount paid for the services or products provided.

9. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Oregon for Oregon-based customers, and the laws of the State of Washington for Washington-based customers, without regard to their respective conflict of law provisions. In the event of any legal disputes, the venue shall be in the appropriate courts of the state in which the services were performed.

10. Business Licensing
Elevated Windows operates under the following licenses:
• State of Oregon Construction Contractors Board License Number: 253029
• Washington State Construction License Number: ELEVAWP762NM

11. Changes to Terms of Service
Elevated Windows reserves the right to modify these Terms of Service at any time. Customers will be notified of any significant changes before they take effect.

12. Photography and Media Release Clause
By agreeing to our services, the Client grants Elevated Windows permission to take photographs of the installed window treatments upon project completion. These photographs may be used by Elevated Windows for marketing purposes, including but not limited to social media, our website, and promotional materials. No personal or identifying details of the property or its occupants will be shared. If the Client prefers not to have photos taken or shared, they may notify Elevated Windows prior to or at the time of installation, and no photos will be used for any purpose.

13. Force Majeure
Elevated Windows shall not be held liable for any delay or failure in performance resulting from acts beyond its reasonable control, including but not limited to natural disasters, government restrictions, supply chain disruptions, labor strikes, or unforeseen events such as pandemics.

14. Product Variation Notice
Due to variations in dye lots, materials, or digital renderings, actual products may differ slightly in color or texture from samples or photos. Elevated Windows is not responsible for minor discrepancies that fall within industry-accepted tolerance levels.

15. Customer-Provided Measurements
If the Customer provides their own measurements for a custom order, Elevated Windows is not responsible for improper fit or installation issues resulting from incorrect dimensions.

16. Acceptance of Terms
By placing an order, signing a quote, or paying a deposit, the Customer confirms they have read, understood, and agree to be bound by these Terms of Service.
